一、内容和范围

1.总则

本合同适用于某__________产品认证的初次，扩大范围和复评认证。

二、质量体系审核和产品抽样检验

1.正式质量体系审核时间拟定在______年______月份进行，最终商定的审核时间，其偏离度不能超过一个月。(甲方如需预审核，希望审核时间在______年______月______日，预审核时间至少比正式审核时间提前一个月。)

2.甲方取得节能产品认证注册资格后，在 年有效期内，乙方对甲方自获证之日起每12个月进行一次监督检查(包括监督审核和监督检验)。有异常情况时，酌情增加监督检查频次。

三、费用及付费时间

1.乙方按中国节能产品认证管理委员会发布的《认证收费管理办法》，对甲方在本合同有效期限内的认证申请(包括扩大型号规格的认证申请)，按下列收费标准收取相关阶段某证费用，收费时，向甲方发出正式的《认证收费通知书》，甲方应按《认证收费通知书》的要求及时向乙方缴纳认证费用。

2.收费标准：

a.申请费：基本费用______元/次，同次申请，每增加一个认证单元增收______元。

6.其它

获证产品公告费按实际支出另行收取。

审核/抽样人员执行审核/抽样任务所发生的差旅费，食宿费按实际支出由甲方支付。

四、甲方的责任和义务

1.在产品认证实施某段某按认证活动进展情况或乙方通知，向乙方提交有关文件和资料或进行必要的工作。

2.在实施某认证时，应提供至少三个月的质量体系运行的有效证据。

3.认证活动开始前，应向乙方明确甲方的保密要求和特殊要求。

4.应向乙方无偿提供抽样检验的样品，负责把抽取的样品按乙方规定的时间，运送到指定的检验机构。甲方保留回收抽检产品的权利。

5.向乙方在甲方现场执行认证任务的人员免费提供通讯设施某通工具，办公设施某络向导及其它必要资源。

6.应按期向乙方及检验机构交付各项认证费用。

7.除本合同规定的条款外，甲方不应再以任何方式或名义向审核/抽样/检验人员馈赠钱，物(包括纪念品，加班费，劳务费等)。一旦发现，乙方将终止认证活动并视认证结果无效。

8.应按《认证证书和标志使用管理办法》的有关规定，正确使用认证证书和认证标志。

9.当质量体系发生变更(如法定代表人，组织名称，地点变更及《质量手册》更改等)，认证证书所涉及内容变更，以及发生重大质量问题和顾客重大投诉时，应及时通报乙方。

10.甲方应确保获证产品在认证证书有效期内，该型号规格产品始终保持产品性能并符合认证要求。其使用的关键零部件和材料应与乙方最终确认的《受控部件/材料备案清单》保持一致，如需变更，应及时向乙方提出申报，经认可后，方可变更使用。未提出认可申请或经检验评定未通过认可时，获证产品不得使用变更的受控部件和材料。一经发现，乙方将对该产品认证证书做出暂停直至撤销的决定，并同进停止使用认证标志。

11.甲方因故被暂停或撤销认证注册资格时，应暂停或停止使用认证证书和认证标志，并向乙方交回全部认证文件。

12.随时接受中国认证机构国家认可委员会(cnab)对甲方的临时调查。

五、乙方的责任和义务

5.1格履行国家产品质量认证方面的法规和国际准则。

5.2 按照标准和有关程序，客观，公正地为甲方提供产品认证服务。

5.3在收到甲方交付的费用后，及时组织实施某的产品认证活动。

5.4乙方的审核组成员应按有关规定配备，并征得甲方同意。

5.5乙方应公正，科学，客观，实事求是地提出问题和处理问题。

5.6乙方应合理选用检验机构。

5.7乙方在做出认证评定结论后，应及时办理是否批准甲方取得和保持认证注册资格的手续。

5.8 在公开出版物上公布获准注册组织的名录。

六、风险

1.甲方建立的质量体系如达不到/不能保持达到 ccc/t032002的有关要求，或产品质量不能保持达到规定要求，将承担不能取得或被撤销认证注册资格的风险。

2.乙方要承担因甲方获证后质量体系失效，产品质量/性能指标下降而引起甲方的顾客不满意被投诉，损害声誉乃至被认可机构暂停，撤销产品认证，注册资格的风险。

七、保密原则

乙方应保守甲方技术，经营和管理秘密，未经甲方书面许可，不得以任何方式泄露给第三方，但下列情况除外：

a.甲方及其关联公司范围外已公开的文件和资料，但不包括第三方侵权所获的文件和资料;

b.法律另有要求时;

c.国家主管部门要求时。

注：国家主管部门指国家经济贸易委员会，国家质量监督检验检疫总局，国家认证认可监督管理委员会和中国质量认证机构国家认可委员会。

八、争议处理

在合同履行过程中发生争议，双方应当协商解决，如不能达成协议，可以：

a.申请中国节能产品认证管理委员会(ccc)仲裁;

b.申请中国认证机构国家认可委员会(cnab)仲裁;

c.按司法程序解决。

九、违约处理

甲方或乙方因各自的原因不能在合同规定的期限内如期进行产品认证，责任方应向对方支付相当于某同规定认证审核费用的5%作为违约金。

甲方或乙方如有违犯合同行为，使另一方遭受损失，则受损失方可要求赔偿损失，但赔偿金额最多不超过本合同规定的认证审核费用。

依据《民法典》和公安部消防产品合格评定中心公开文件的规定，合同双方就产品认证项目协商一致，签订本合同。

一、适用范围

1.1本合同适用于消防产品质量强制性认证的新申请，变更申请和复评申请的受理、审查、注册和监督全过程。对于变更申请，本合同为原合同的补充，原合同的未变条款仍然有效。

二、双方责任

2.1乙方责任：

2.2甲方责任：

向乙方提供认证所需要的全部资料，为乙方提供必要的工作条件，并积极配合认证工作，保证其顺利进行。提供质量手册，申请书及附件和至少三个月的质量管理体系运行的有效证据。按时向乙方交付规定的费用。遵守cccf有关认证证书保持，暂停、撤消和注册的要求，在证书有效期内，甲方质量管理体系，产品变化时应及时通知乙方，遵守有关认证标志使用的要求，接受乙方按国家有关规定进行的监督审查。

2.3乙方对甲方的保密承诺：

乙方不得将甲方经营，生产状况及技术资料以任何方式泄露给第三方，但以下情况除外：

2.3.4国家主管 部门要求时。

三、风险

3.1甲方建立的质量管理体系和产品质量如达不到或不能保持达到标准要求和乙方的规定要求，将承担不能取得证书或被撤消认证资格的风险。

3.2因甲方获证后不按认证审查过程的质量管理体系运行，产品质量下降，发生质量事故等造成产品不合格而引起被顾客投诉或产品质量监督部门查处，乙方不承担任何责任。

3.3对认证过程中或监督审查中甲方因乙方责任的任何损失，其索赔的赔偿费将不得超过甲方的认证审查费或本次监督审查费;乙方将不承担随后的任何损失赔偿。

四、审查时间

5.5本合同一式二份，甲方和乙方各执一份，自甲方交费之日起正式生效;如一年内，甲方未能按规定交费，则本合同自行终止。

六、争议处理

合同履行过程中发生争议。双方应首先协商解决。如达不成协议，可以：

(a)申请北京市技术合同委员会仲裁□;
